Nipping Cyber-Bullying In The Bud | Tempo - News in a Flash

Manila, Philippines ? We?ve all heard about cyber-bullying and more so, lately, here in our country ? a bill is being passed about it but as unpleasant as its effects are on people, there are still those who aren?t too keen about passing the law that would see perpetrators serving time in the slammer!?

Well, back on the subject. Here?s an update on this. The Philippine government has asked the Supreme Court to lift the temporary restraining order (TRO) on the controversial Cybercrime Prevention Act of 2012, and junk 15 petitions contesting the law. According to GMA News Online last Monday, the government, through the country?s Office of the Solicitor General (OSG), argue the issuance of the temporary restraining order on the implementation of cybercrime law ?should not be made to rest merely on purely legal arguments, without evidence being introduced, for or against the validity of a challenged statute?.

Now with the TRO lifted there again is the uproar on the Cyber Crimes law in the land. But I ask myself, why not, really? The law only ?regulates and penalizes? acts defined as cybercrime such as hacking and believe me I for one would love to see those perennial hackers of mine take on some punishment.

The Cybercrime Prevention Act of 2012, officially recorded as Republic Act No. 10175, is a law in the Philippines approved on 12 September 2012. It aims to address legal issues concerning online interactions and the Internet in the Philippines. Among the cybercrime offenses included in the bill are cybersquatting, cybersex, child pornography, identity theft, illegal access to data and libel.

While hailed for penalizing illegal acts done via the internet that were not covered by old laws, the act has been criticized for its provision on criminalizing libel, which is perceived to be a curtailment in freedom of expression. The Philippines? Cybercrime Prevention Act had been suspended for 120 days following restraining order against it by the Supreme Court in October. The law had come under fire for its vague definition of online libel, violation of personal rights and tough legal penalties for Internet defamation.

The cyber law her won?t infringe on people from using the Internet and expressing their thoughts. It?s not a ?gag order.? If any, this will give us a blanket of protection. It?s not out to curtail one?s freedom of speech it?s going against ?abusers? of that freedom. In my honest opinion, I AM ALL FOR IT. If only for the fact that I?m a constant target of every kind of cyber bullying, well I?ve had my accounts (email, Facebook even my phones!) hacked over and over again.

Cybercrime to address the perennial crimes spawned by the Internet such as online pornography and cyber prostitution. Those evil doers are who the cyber bill should be for. Freedom of expression shouldn?t mean freedom to hack away at anybody?s emails, social media site profiles or posting personal videos and malicious images. And it?s no doubt we need a law on.

Security Guards Seek Union Contract - Courant.com

HARTFORD ? Nearly 40 security guards who work in state buildings have failed to persuade their private employer to negotiate a first union contract, though they joined the Service Employees International Union, Local 32BJ a year and a half ago.

Wednesday, some of those guards were joined by labor officials from other local unions and a smattering of politicians, and after a few short speeches, the group of about 80 people marched a half-mile in the bitter cold, starting in front of a state building near The Bushnell arts center.

Many carried signs that said "I Am a Man," an echo of the Memphis sanitation workers' signs in 1968. Martin Luther King Jr. had traveled to their strike to support them, and was assassinated during that trip.

Even without a contract, the union has gotten some results for the workers. It convinced the state that it should conduct an audit to determine whether the company, SOS Security of New Jersey, was paying the rates described in its contract with the state. It is obliged to pay between $9.23 and $12.30 hourly, depending on experience.

Because the company was not paying the full rate to some workers, and did not give time and a half on holidays, it paid about $16,000 in back wages to about 30 workers. It later gave thousands in back pay to former workers.

Wilfredo Rodriguez of Hartford said he has been an SOS security guard for more than eight years and makes $12.30 an hour. He said he hasn't had a raise in seven years.

Rodriguez said he wanted to join a union "to be respected. They don't want to listen to us."

He said so far, the union hasn't gotten them a voice with the company. "It's always the same thing. They refuse to sit down with us," he said.

The company declined to comment for this story.

Rodriguez said they would continue the fight.

Under terms of the company's contract with the state, the company is required to maintain "a tranquil working relationship between the Contractor work force, the Contractor Parties and their work force. ... The Contractor shall quickly resolve all labor disputes."

The US internet service providers market has greatly benefited from the move toward ubiquitous internet access and the exponential growth of internet traffic.

Through the five years leading up to 2012 industry revenue has grown at an annualised rate of 2.3% to hit a market value of $47.9 billion. Furthermore, regulatory overhaul in 2012 will necessitate government-subsidised network expansion and increase the number of US broadband connections, driving revenue growth.

Access to the Internet can be divided into dial-up and broadband access. Around the start of the 21st century, most residential access was by dial-up, while access from businesses was usually by higher speed connections.

In subsequent years dial-up declined in favour of broadband access. Both types of access generally use a modem, which converts digital data to analog for transmission over a particular analog network.

Business customers have emerged as the most lucrative growth market in the Internet Service Providers (ISP) industry. The increasing adoption of cloud computing (which involves accessing data and software through the internet) is boosting demand for high-speed access services.

Additionally, ISPs are increasing their array of value-added services, acquiring cloud and infrastructure consulting firms to profit further from the business market.

The leading broadband provider in the United States is SBC Communications (AT&T) with 14.8 million subscribers as of the third quarter of 2008. SBC is followed by Comcast, Time Warner, and Verizon. And while there are many cable companies offering broadband services in the United States, three are seen as the main providers: Comcast, Time Warner, and Cox Communications.

The United States has over 67.7 million people subscribed to the top broadband providers, which accounts for 94% of the market.

In measurements made between January and June 2011, the United States ranked 26th globally in terms of the speed of its broadband Internet connections, with an average measured speed of 4.93 Mbit/s. South Korea led the list with an average of 17.62 Mbit/s, followed by Romania (15.27 Mbit/s) and Bulgaria (12.89 Mbit/s).

In recent years, consumers have increasingly viewed the internet as a necessity rather than a luxury, a perception that will only become more widespread over the coming years. As internet traffic continues to increase, ISPs will exercise more control over their networks and will likely restructure their pricing to a usage-based model, which likely elicit strong opposition from consumers.

Craft Room Organizing Is Pure Madness | Marryl All Write

It?s been over a year since I?ve posted about how to go about organizing our little craft/office room. It?s a really tiny room where we have our computer, printer and our craft supplies. Ours because my hubby used to do scale modeling and so his air brush and acrylic paints are there along with my sewing, beads and all other craft supplies that seems like it has taken a life of its own. It?s pure madness!

This tiny room drives me crazy but the stuff that?s in there is where I get pure joy making and creating things. We decided to take it one corner at a time starting with the smaller stash of supplies. This photo was taken last month and it was a feat to have finally seen the wooden table surface coz I?ve forgotten how it looked like. There were always stuff on that table.

For those of you following me, you? know about my love affair with candle lanterns and I seem to have them all over the house now.

Suddenly, it?s not just craft supplies there. There?s an addition to this family ? Law books! And lots of them just scattered everywhere. Urgh! That picture below was taken a few minutes ago. Madness!

Stay tuned for a post about that gratitude jar on the table. My five-year old daughter is telling me we need to have some tea / milk and brownies with all her Barbie dolls. There?s a tea party with the Barbies happening right about now =)

    SARASOTA, Fla. (AP) ? On a recent sunny winter day on a downtown Sarasota street corner, a cluster of homeless men lounged on the back steps of a building, grimy backpacks and bags at their feet, while a few folks ambled to the nearby bus station.

    Parked at a meter just feet from them was a red Ferrari and around the corner was Sur la Table, an upscale cookware store offering $400 juicers.

    Newer, wealthy residents in the Gulf Coast city known for its arts scene and beautiful beaches are buying expensive downtown condos so they can live an urban lifestyle ? but don't want the problems associated with a city, including the 700 or so homeless people who inhabit the county, the American Civil Liberties Union and others contend.

    They also say authorities, including police, are trying to harass the homeless into leaving the town of 53,000 full-time residents.

    Recently, the ACLU uncovered a surveillance video showing an officer throwing a homeless man against a metal grate and received public records that show officers sent messages to each other about "bum hunting."

    "We thought those messages were beyond just being juvenile, but was sort of indicative of the atmosphere that existed in the city," said Michael Barfield, the legal chair of the ACLU in Sarasota.

    To be sure, other warm-weather cities have grappled with problems associated with the homeless. In Florida, Key West has periodically cracked down on "quality of life" offenses such as aggressive panhandling and using residents' outdoor showers. Miami-Dade County counted nearly 4,000 homeless people either sleeping on the street or in shelters within its borders one year ago.

    Barfield said that in the past 18 months, the city has targeted the homeless by removing benches and banning smoking in downtown parks and arrested a homeless man for charging his cellphone on a city-owned outlet in a park. The charge was later dropped.

    "I think for a long time we've had a lot of issues. The fact that we have a lot of wealthy people downtown, we have a few condos that cater to that type of people, and they're not quite used to dealing with the lowly and downtrodden," said Steve McAllister, a Sarasota native who says he chooses to be homeless and live a lifestyle based on bartering. "And so when we have homeless people come here because of the weather or the opulence or whatnot, we get a lot of clashes between the two classes."

    The ACLU has filed five lawsuits against the city ? some have been settled and the smoking ban has been struck down by a judge.

    Police Chief Bernadette DiPino ? who took the helm of the department in late December ? says the agency is conducting an internal investigation of both police issues raised by the ACLU.

    "The city of Sarasota is working aggressively to learn as much as it can to learn about homeless issues in this community," DiPino said. "There's been a number of complaints from citizens and business owners about people who are sleeping or on the sidewalks or are begging for money. We try to apply the appropriate response to the complaints we're getting from citizens."

    She and other city officials say Sarasota actually offers many more services to the homeless than other communities. Officials point to statistics that show there have been about 25,000 instances of documented police contact with the homeless between 2004 and 2012, with 1,416 people referred to various social service programs by officers.

    DiPino said that like other communities, Sarasota must balance its responsibility to help people with drug, alcohol and mental health issues with keeping other residents safe and happy.

    Phil Grande is a downtown business owner and one-time resident who spearheaded the effort to remove benches from the parks.

    Grande, a syndicated radio host, in 2010 purchased an expensive condo in the same building as his downtown studio. He quickly noticed that student groups fed the homeless in a nearby park and that people congregated near the library, used drugs and hassled people on the street.

    He said the troublemakers are often aggressive, younger men.

    "This isn't a homeless problem," Grande said. "The homeless are pretty much taken care of. This is a vagrant situation."

    Grande said there was a "parade" of homeless from the bus station to the library. Many business owners complained to the city and Grande contends leaders were reluctant to take action because they were "very liberal" and didn't want more downtown development. At one point, a frustrated Grande chartered a bus for the homeless and drove them from downtown to a million-dollar neighborhood where one city official lived ? and proceeded to feed the homeless in front of the official's home.

    Eventually, the benches were taken out of the parks.

    "Once the benches were removed, the parade really diminished," he said.

    Grande sold his condo and now lives in a gated community. He said he's donated time, money and food to homeless programs, including an offer of buying a building where the city and groups could distribute food ? an offer, he said, that was rejected by officials.

    Leslie Loveless, the interim executive director of the Suncoast Partnership to End Homelessness, said part of the problem is that because Sarasota is such an upscale area, inexpensive housing is difficult to find, even if a homeless person were to snag a job.

    "We need to look at transitional and permanent housing that's affordable," she said.

    The Center for Housing Policy concluded that in late 2011, only 28 percent of the jobs in the area could earn enough to afford a two-bedroom apartment. To qualify as "affordable," rent must be less than 30 percent of monthly income.

    Some of the homeless contend that only a few troublemakers cause all problems, while the rest are trying to extricate themselves from the cycle of joblessness and poverty. James Franklin Jr. spends his days on a bench outside City Hall ? and says he's never had issues with officers or city officials. Still, Franklin said he's concerned about the overall societal attitudes about the homeless.

    "I've been homeless, I've been a vagrant and now I'm a bum that's being hunted by bum hunters. You know, call me what you're going to call me, but quit switching me up," he said. "Call me James Franklin Jr., whether my situation is good or bad. I respect you and I expect you to respect me."

    JPMorgan's Jamie Dimon gets big pay cut

    NEW YORK (AP) ? America's best-known banker is getting a big pay cut.

    JPMorgan Chase said Wednesday that it will dock the pay of CEO Jamie Dimon by more than half, to $11.5 million from $23 million.

    It's the latest fallout from an embarrassing trading loss at the bank last year, one that eventually ballooned to $6 billion. Its ripple effects have already been numerous, forcing Dimon to appear contritely before Congress and putting the bank squarely in the cross hairs of regulators and lawmakers.

    The pay cut didn't come as a surprise on Wall Street. What set it apart was that it amounted to a reprimand from the bank against a CEO who remains popular and well regarded, despite the stain of a trading loss that Dimon once dismissed as a "tempest in a teapot."

    And even as it cuts his pay, the board of directors praised Dimon for responding "forcefully" to the trading loss, presiding over an overhaul of the bank's risk management and booting out responsible executives. A report from a bank task force placed most of the blame on other executives and traders who have since left.

    Compensation consultant James F. Reda was underwhelmed. He called Dimon's pay cut "ceremonial," a way for the bank to show that it is paying penance.

    "He doesn't need the money," Reda said. "He was probably very proactive in accepting this to keep people off his back. To get punished, if you will, so he can then point to that and say, 'Look, I was punished. Isn't that enough? Leave me alone. Let me run my business.'"

    Dimon's job was never seriously in danger, even with the trading loss, and the pay cut hasn't changed that perception. Wall Street saw it less as an indictment of Dimon and more as a sign of the board's commitment to taking the trading loss seriously.

    "It's bitter medicine, but he swallowed it and is moving on," said James Post, an expert on corporate governance who teaches at Boston University. "I think that still leaves him in a very strong leadership position in both the bank and the industry."

    JPMorgan, and Dimon, are essential players in U.S. banking. JPMorgan emerged from the financial crisis as one of the strongest banks in the country, a winner in a meltdown that forced other banks to their knees. Its blockbuster fourth-quarter earnings, which were released Wednesday, will almost certainly cement it as the most profitable U.S. bank of 2012.

    Such accomplishments have made Dimon one of the best known, and most outspoken, bank leaders of his generation, even in a time of heightened scrutiny and public anger against the industry.

    While some of his peers have tried to stay under the radar, he has spoken out against many new regulations ? including some, the bank's critics say, that could have prevented the trading loss.

    Dimon has publicly chafed at criticism of banking's big pay packages, including President Barack Obama's famous "fat-cat bankers" comment. "Acting like everyone who's been successful is bad and because you are rich, you are bad ? I don't understand it, I don't get it," he told an investment conference.

    On calls with reporters and analysts Wednesday, he was his usual swashbuckling self, intensely proud of the bank he runs and sometimes impatient with critical questions.

    He said the portfolio where the troubled bets were made is "very close to being a non-issue" as far as trading losses are concerned. Asked for thoughts on his pay cut, Dimon said he respected the board's decision. Pressed for his "gut feeling," he replied, "Nope, you're not gonna get it."

    When analyst Guy Moszkowski asked about the "exotic investment strategies" of the Chief Investment Office, where the loss occurred, he shot back, "It has got not a damned thing to do with exotic investment strategies ? zero, nada, nothing. OK?"

    For 2012, Dimon will get $1.5 million in salary and $10 million in restricted stock awards. It likely means that he'll no longer be the highest-paid CEO among the country's six mega-banks.

    Even with the pay cut, and even by the lofty standards of big-time CEOs, the 56-year-old Dimon will still be well paid. The median pay for CEOs of S&P 500 companies for 2011 was $9.6 million, according to the latest data from executive compensation firm Equilar.

    Though Dimon made clear that he is eager to put the so-called London whale loss behind him, there could be more reminders in store.

    The bank has said it received requests for information related to government inquiries and investigations by Congress, the Department of Justice, the Securities and Exchange Commission, the Commodity Futures Trading Commission, the U.K. Financial Services Authority, the state of Massachusetts and others.

    On Monday, the Federal Reserve and the Office of the Comptroller of the Currency, both bank regulators, slapped sanctions on JPMorgan for the trading loss and ordered it to tighten up its risk management procedures. The bank neither admitted nor denied wrongdoing, but said it was working to correct any issues identified by the regulators.

    The bank released two reports Wednesday on the loss, one from bank executives and the other from the board of directors. These said that traders and executives in the Chief Investment Office didn't understand the risks they were taking, didn't adequately question risky decisions and didn't properly report ballooning losses.

    The board of directors said executives didn't keep them adequately informed about potential problems and used unapproved models for calculating risk.

    Despite the fallout from the trading loss, JPMorgan turned in a strong fourth quarter. Earnings shot up 55 percent over the same period a year ago to $5.3 billion after paying preferred dividends, up from $3.4 billion.

    Per share, those earnings amounted to $1.40, blowing away the $1.16 expected by analysts polled by financial data provider FactSet. The bank's stock rose 47 cents to $46.82, up 1 percent.

    Revenue also beat Wall Street's forecasts, rising 10 percent to $24.4 billion, after stripping out an accounting charge. Mortgage originations jumped 33 percent.

    Dimon said the housing market "has turned," echoing a statement he made in October after the third-quarter earnings report.

    RI Police: Mass. Man 4 Times Legal Limit While Driving ? CBS Boston

    RICHMOND, R.I. (AP) ? Rhode Island State Police say a Massachusetts man arrested on suspicion of drunken driving registered a blood alcohol level of 4? times the legal limit.

    Col. Steven G. O?Donnell says an off-duty Connecticut state trooper called 911 on Saturday night to report a possible drunken driver on a Richmond highway. Troopers stopped the vehicle and arrested 43-year-old Thomas J. Eaton, of South Attleboro, on charges of DUI and driving on a suspended license.

    Police gave Eaton two breath tests. They say the first reading was 0.362 percent, and the second came back as 0.356 percent.

    The legal limit for driving is 0.08 percent.

    Police say Eaton was also arrested on DUI charges in 2005 and 2008.

    O?Donnell says Eaton was arraigned and is being held at the Department of Corrections.

    Union boss urges civil disobedience

    A union leader has called for a campaign of "civil disobedience" in protest at the Government's austerity measures.
    Unite's Len McCluskey pledged to "fight all the way to the next election" as he said no form of protest, including the prospect of a general strike, should be ruled out.
    He said the Government's policies, designed to balance the nation's books, were leaving working people feeling "battered".

    Durant's 42 helps send Lakers to 6th straight loss

    LOS ANGELES (AP) ? Kevin Durant hit a 3-pointer in the final second of the first half and did a full reverse somersault to celebrate a 16-point lead. The Thunder were running the Lakers out of their own building, and not even Kobe Bryant could stop them.

    Oklahoma City is again clearly among the best teams in the Western Conference, and the struggling Lakers may not have enough time left in the season to join them.

    Durant scored a season-high 42 points, Russell Westbrook had 27 points and 10 assists, and Oklahoma City easily sent the short-handed Lakers to their sixth straight loss, 116-101 on Friday night.

    Kevin Martin scored 15 points and hit three 3-pointers for the Thunder, who romped to a 27-point lead in the second half. Oklahoma City has won seven of nine, while Los Angeles is on its longest skid since March 2007 while playing without injured stars Dwight Howard and Pau Gasol.

    Oklahoma City (28-8) matched the Clippers for the NBA's best record ? and the Thunder made it look easy with a virtuoso game from Durant, who had 38 points midway through the third quarter.

    "Coming in here, it's tough to win no matter what," Durant insisted after the Thunder coasted down the stretch. "We did a great job of just playing together at both ends of the floor all night and not taking those guys lightly. They've got two of the best players in the world out, so we just wanted to come out and have a good game."

    They had a bit more than a good game. Durant hit four 3-pointers and his usual array of athletic shots whenever he wanted, while Westbrook finished three rebounds shy of a triple-double while playing less than 35 minutes.

    The Thunder only had three scorers in double figures, but that was more than enough.

    Westbrook, a Los Angeles native, has little sympathy for the Lakers.

    "They're not done. They have a lot more games left, and I'm pretty sure they're going to find a way to get it together," Westbrook said. "Our job is to worry about our team and our organization. It wasn't easy. I just think we did a good job of playing team basketball defensively, and it showed. Kevin took control most of the game."

    The Lakers (15-21) hadn't lost this many consecutive games since the year before they acquired Gasol and embarked on a run to three straight NBA finals. With Cleveland and Milwaukee visiting over the next four days, the Lakers have a chance to get competitive again ? but they're facing an uphill climb just to get into playoff contention.

    "I told the team, the biggest thing is our season starts Sunday," coach Mike D'Antoni said. "We've got to make a run. We've got one shot at it, and everybody needs to get ready mentally and physically. From there on, we can't make any more false steps. That's just how it is. We put ourselves in this ditch, and we're the only ones that can get it out, and hopefully we can get some guys back and start our season Sunday."

    Bryant scored 28 points and Antawn Jamison added 19 against Oklahoma City, but Los Angeles looked lost and overmatched in its third straight game without Howard and Gasol.

    The Thunder eliminated Bryant and the Lakers from last season's playoffs in five games, and Los Angeles has shown few signs of being able to compete with the defending conference champions this season. Injuries aren't the only problem, but Howard likely is out for at least another week with a shoulder injury, while Gasol still hasn't been cleared to return from his concussion.

    "We're just very frustrated and upset about what we're going through right now, and how we're playing," Bryant said. "We're going to have to make some big adjustments if we're going to be successful. We gave up about 120 points tonight, and a lot of them were just layups and easy looks at the rim."

    Steve Nash had seven points and seven assists in a quiet 30 minutes for the Lakers, who announced during the second quarter that backup big man Jordan Hill likely needs season-ending surgery on his left hip. Metta World Peace added 12 points, going 1 for 9 on 3-point attempts.

    "We showed some fight, but we just were a little overmatched," Nash said. "They're bigger than us at almost every position. Kevin got hot, and we couldn't contain him in the second quarter. As the game wore on, I just think the difference in depth and quality took over."

    NOTES: Before the game, Bryant and his wife, Vanessa, announced they've called off their divorce proceedings. Vanessa Bryant filed for divorce in December 2011. ... The teams meet again at Staples Center on Jan. 27. Oklahoma City also visits to face the Clippers on Jan. 22. ...
